Seminar zum Thema "Geistiges Eigentum - Digitale Tools" [SP 3, 4]

Im Sommersemester wird ein Seminar angeboten, das sowohl den Einsatz von „Digitalen Tools“ zum Schutz von Geistigem Eigentum als auch den Schutz Digitaler Tools durch Rechte des Geistigen Eigentums behandelt.
Digitale Tools wie Blockchain, Big Data, Künstliche Intelligenz, Augmented und Virtual Reality sowie Digitale Twins treiben Innovation und Produktangebot nicht nur im medialen und privaten Sektor voran, sondern sind auch unverzichtbare Bausteine der Industrie 4.0. Zugleich weist die Verbindung von realer und digitaler Welt ein erhebliches Potential auf, beschränkte Ressourcen effizient zu nutzen: Entfernungen können ohne Reisen überbrückt werden, Prototypen ohne den Einsatz von Rohstoffen erstellt und getestet werden, Produktionsanlagen können mit geringerem Zeit- und Materialeinsatz betrieben werden. Allerdings setzt die Entwicklung digitaler Tools ihrerseits eine kreative, erfinderische Tätigkeit und häufig ein erhebliches Investitionsvolumen voraus. Entsprechend groß ist das Interesse der Unternehmen ihre Leistungen zu schützen. Aus der Perspektive des Rechts des Geistigen Eigentums stellt sich die Frage, ob das Gesetz durch die bestehenden technischen Schutzrechte den nötigen Anreiz setzt.
Die Bedeutung Digitaler Tools für das Recht des Geistigen Eigentums reicht aber weit über die Frage der Schutzfähigkeit hinaus. Denn sie könnten ihrerseits für die Recherche im Anmeldeverfahren und der Freedom to Operate Analyse eingesetzt werden, Aufschluss über die Patentqualität geben oder für das Auffinden von Patentverletzungen genutzt werden. Je häufiger sie in der Praxis eingesetzt werden und je leistungsfähiger sie sind, desto näher liegt es zudem solche Tools – sei es als Beweismittel oder in Form von Legal Tech – auch im Verletzungsprozess einzusetzen.
Die Themen umfassen bspw.
- Schutz Digitaler Twins durch das PatG,
- Infringement Hunting: Einsatz von KI zur Aufdeckung von Schutzrechtsverletzungen
- KI-basierte Bewertung von Schutzrechten
- Einsatz von Blockchain zur Überwachung des Lizenznehmers
Insgesamt stehen 10 Themen / Seminarplätze zur Verfügung. Die Themen werden am 30.1.23 bekanntgegeben.
Für die Teilnahme ist eine verbindliche Anmeldung unter Angabe des gewünschten Themas sowie eines Alternativthemas erforderlich. Bitte senden Sie eine Email an ls-mcguire@uos.de. Sobald Ihre Teilnahme bestätigt ist, können Sie mit der Bearbeitung beginnen.
Ende März wird eine Besprechung angeboten, um Formalia & zwischenzeitlich aufgetretene Fragen zu klären. Abgabetermin für die Arbeiten ist der 8.5. Die Seminarvorträge finden als Blockveranstaltung am 10. und 11.5 in Osnabrück statt.
Die Seminarthemen entsprechen den Referatsthemen der Osnabrücker Patenttage am 26.5.2023, bei denen Referenten aus Wissenschaft und Praxis vortragen werden. Alle Seminarteilnehmer:innen sind eingeladen, an der Tagung teilzunehmen.
